South Carolina’s Mount Pleasant municipal Judge Larry Duffy has put another nail in the coffin of conservative poker regulation in the United States with a recent ruling regarding the ever popular Texas Hold ‘Em card game. Judge Duffy ruled that the evidence was “overwhelming” that poker was indeed not a game of pure chance. And several expert witnesses were called in to testify. Professional poker player Mike Sexton and Dr. Robert Hannum, statistics professor at the University of Denver, were among those who testified that day.

And that brings us to the case itself. It all began with a home poker game that was raided by police in 2006. 20 men were charged and booked, but 5 decided to fight back.

The fight was over an archaic law, one written in 1802 in the state of South Carolina, and while the judge ruled “in the spirit of the law” that the game was in fact not a pure game of chance, he declared the men guilty still and ordered them to pay the fines initially charged to them.

However, the fact that the judge ruled in favor of skill based poker has some optimistic about the tides of the law regulating the game. In this instance, though the judge was in too low a court to have a true effect on the state law, the State attorney general seems to back the ruling and it very well may prove to be a persuasive ruling to be used in a higher court. The current case is now on appeal.
